Immigration Court Cases (Non-detained)
There are over 400 (400) Immigration Courts located around the U.S., and twelve (12) courts located in Arizona. In Immigration Court, immigrants have the right to retain private counsel of their own choosing. Unlike in criminal court cases, the government does not provide immigrants with an attorney.
In general, the purpose of Immigration Court is determine whether an immigrant is subject to removal (deportation), and if so, whether the immigrant is eligible for any form of relief from removal to avoid deportation. If you are currently in immigration court proceedings, it is highly recommended that you consult with a licensed attorney as soon as possible.
The most common forms of relief from removal are cancellation of removal for permanent or non-permanent residents, adjustment of status, asylum, and voluntary departure. Due to the high volume of immigration cases, your case may also be subject to administrative closure. Each form of relief has specific rules and requirements, and there are other factors which may determine eligibility, such as criminal convictions or the existence of family members.
